By booking, you accept and agree to all terms and conditions described herein.

Departure time: depending on weather and tides conditions, Gulf Breeze might change departure time, notifying Client the previous day by email / phone.

While dolphins often grace us with their presence and come close to our boats, they are incredible wild animals, and their appearances are not guaranteed.

Please be informed there are no bathrooms on board.

Pets are not allowed on boards.

Children under the age of six must wear lifejackets at all times.

Cancellation policy: Guests can cancel rides/tours without penalty up to 48 hours before departure. Please notify us by phone or email. Cancellations within 48 hours and no-shows are subject to full charges. We offer a 100% refund or reschedule within 3 months for rides/tours canceled by Gulf Breeze Charters due to weather conditions or tides. These options are subject to availability and must be arranged through our reservations team.

Promotional Usage: The photographs and videos taken by our staff may be used for promotional purposes, including but not limited to social media posts, advertisements, website content, brochures, or other marketing materials. These materials aim to showcase the quality of our tours and the enjoyable experiences that participants can expect.

Participant Consent: By participating in our tours, you grant us the irrevocable right and permission to use your likeness, including any photographs or videos in which you appear, for promotional purposes as described above. This consent extends to the use of your images in both digital and print media.

If you have any concerns regarding the use of images featuring you or any specific requests related to privacy, please inform our staff before or during the tour.

Privacy and Confidentiality: We are committed to respecting your privacy and confidentiality. We will not disclose any personal information or use any images in a manner that could compromise your privacy or violate any applicable laws or regulations.

Alcohol and Tobacco Policy: All tobacco products strictly prohibited.

No Red wine allowed on our boats.

Compliance with Laws and Regulations: The Company operates its boat tours in compliance with all applicable federal, state, and local laws and regulations, including but not limited to boating laws, safety regulations, and environmental protection measures.

Governing Law and Jurisdiction: This Agreement shall be governed by and construed in accordance with the laws of the State of Florida.

Personal Conduct: We expect all participants to behave in a respectful and considerate manner during the tour. Any behavior that endangers others or disrupts the experience may result in immediate termination of the tour without refund.

CONSUMPTION OF DRUGS AND ILLEGAL SUBSTANCES
At our boat tour company, we prioritize the safety, well-being, and legal compliance of our customers. We have a zero-tolerance policy when it comes to the consumption of drugs and illegal substances during our tours. By participating in our tours, you acknowledge and agree to the following disclaimer:

• 1. Prohibition of Drug and Illegal Substance Consumption: The consumption, possession, or distribution of drugs and illegal substances is strictly prohibited during our tours. We have a responsibility to provide a safe and legal environment for all participants. Any individuals found engaging in such activities will be immediately removed from the tour, and appropriate legal actions may be taken.
• 2. Adherence to Local Laws and Regulations: Our boat tours operate in compliance with all applicable local, state, and federal laws. It is your responsibility as a participant to be aware of and abide by the laws regarding drug and substance use in the area where the tour takes place. We do not condone or facilitate any illegal activities during our tours.
• 3. Personal Liability: By participating in our tours, you acknowledge that you are solely responsible for your actions, decisions, and compliance with the law. We cannot be held liable for any legal consequences, injuries, or damages resulting from the consumption or possession of drugs or illegal substances during or after the tour.

We maintain a strict stance against the consumption of drugs and illegal substances during our tours to ensure the safety, comfort, and enjoyment of all participants. We reserve the right to refuse service to anyone suspected of violating this policy. We encourage you to prioritize your well-being, follow the law, and respect the rights and safety of others.

PERSONAL PROPERTY LOST
While we strive to provide a safe and secure environment during our boat tours, we would like to inform our valued customers that we cannot be held responsible for any personal property lost or damaged during the tour. We encourage all passengers to take necessary precautions to safeguard their belongings.

In the event of any lost or damaged personal property, we advise customers to immediately notify the boat crew or our staff. While we will make reasonable efforts to assist in locating lost items, we cannot guarantee their recovery.

We recommend that you refrain from bringing valuable or irreplaceable items on board. We understand that accidents can happen, and we regret any inconvenience caused. However, we cannot assume liability for personal property losses.

By participating in our boat tours, you acknowledge and accept this disclaimer regarding personal property lost or damaged.

CONTRACTUAL ASSUMPTION ACKNOWLEDGEMENT OF RISKS AND LIABILITY WAIVER AND RELEASE AGREEMENT

IN CONSIDERATION of being permitted to participate in the charter/rental provided by Gulf Breeze Charters Inc. for myself and/or any minor children for whom I am the legal parent/guardian or otherwise responsible, and for my/our heirs, personal representatives, people included in the reservation under my name or assigns:

ACKNOWLEDGEMENT OF RISKS

I fully acknowledge that some, but not all of the risks of participating in the charter in which I am about to engage may include (1) wind shear, inclement weather, lightning, variances and extremes of wind, weather and temperature; (2) any sense of balance, physical condition, ability to operate equipment, swim and/or follow directions; (3) collision, capsizing. sinking or other hazard which result In wetness, injury, exposure to the elements, hypothermia, impact of the body upon the water, injection of water into my body orifices, and/or drowning; (4) the presence of and/or injury, illness or death resulting from insects, animals and marine life forms; (5) equipment failure, operator error, transportation accidents; (6) heat or sun related injuries or Illness, including sunburn, sunstroke or dehydration; (7) fatigue, chill, and/or dizziness which may diminish my/our reaction time and increase the risk of an accident; (8) slippery decks and/or steps when wet;

I specifically acknowledge that I have been given instructions/training in the safe use of the type of equipment used during this charter to my complete satisfaction, I understand them fully and I am physically/mentally able to participate in the charter which I am about to engage.

I understand that past or present medical conditions may be contraindicative to my participation in the charter/rental. I affirm that I am not currently suffering from a cold or congestion or have an ear infection. I affirm that I do not have any infectious disease or illness (e.g., COVID or similar variants). I affirm that I do not have a history of seizures, dizziness, or fainting, nor a history of heart conditions (e.g., cardiovascular disease, angina, heart attack). I further affirm that I do not have a history of respiratory problems (e.g., emphysema or tuberculosis). I affirm that I am not currently suffering from back, spine and/or neck injuries. I affirm that I am not currently taking medication that carries a warning about any impairment of my physical or mental abilities.                

CONTRACTUAL/EXPRESS ASSUMPTION OF RISK AND RESPONSIBILITY

I fully agree to assume all responsibility for all the risks of the Gulf Breeze Charters Inc to which I am about to engage, whether identified above or not (I FULLY UNDERSTAND THAT I UNDERTAKE EVEN THOSE RISKS ARISING OUT OF THE NEGLIGENCE OF THE RELEASEES NAME BELOW). My/Our participation in the charter is completely voluntary. I assume full responsibility for myself and any of my minor children for whom I am responsible. This responsibility that I assume on my behalf and that of my minor children, or those children for whom I am legally responsible, extends to any bodily injury, accidents, illnesses, paralysis, death, loss of personal property and expenses thereof as a result of any accident which may occur while we participate in the activity. I COMPLETELY UNDERSTAND AND AGREE TO ACCEPT ALL RESPONSIBILITY ON BEHALF OF MYSELF AND MY MINOR CHILDREN, OR THOSE CHILDREN FOR WHOM I AM LEGALLY RESPONSIBLE, EVEN IF THESE INJURIES, DEATH, OR LOSS OF PERSONAL PROPERTY ARE CAUSED IN WHOLE OR IN PART BY OUR NEGLIGENCE.

This Agreement shall be governed by the laws of The United States of America Any legal action relating to or arising out of this agreement against or with respect to Francesco Lanza shall be commenced exclusively in the United States of America. Any legal action relating to or arising out of this Agreement against or with respect to any of it Francesco Lanza affiliated or related companies shall be commenced exclusively in the Collier County Court. I agree that I will reimburse in full any attorney fees incurred by the assured or their Insurers to defend any legal action under this agreement.

I HEREBY RELEASE Francesco Lanza, THEIR AFFILIATED AND RELATED COMPANIES, THEIR PRINICIPALS, DIRECTORS, OFFICERS, AGENTS, EMPLOYEES, AND VOLUNTEERS, THEIR INSURERS, AND EACH AND EVERY LANDOWNER, MUNICIPAL AND/OR GOVERNMENTAL AGENCY UPON WHOSE PROPERTY AND ACTIVITY IS CONDUCTED, AS WELL AS THEIR INSURERS, IF ANY, EACH AND EVERY CRUISELINE OR COMPANY WHO FACILITATED PARTICIPATION AND/OR PURCHASE OF TICKETS, OR FROM ANY AND ALL LIABILITY OF ANY NATURE FOR ANY AND ALL INJURY, PROPERTY LOSS OR DAMAGE (INCLUDING DEATH) TO ME OR MY MINOR CHILDREN AS WELL AS OTHER PERSONS AS A RESULT OF MY/OUR PARTICIPATION IN THE ACTIVITY, EVEN IF CAUSED BY MY NEGLIGENCE OR BY THE NEGLIGENCE OF ANY OF THE RELEASEES NAMED ABOVE, OR ANY OTHER PERSON (INCLUDING MYSELF).

I have read this assumption and acknowledgement of risks and release of liability agreement I understand fully that it is contractual in nature and binding upon me personally. I further understand that by signing this document I am waiving valuable legal rights including any and all rights I may have against the owner, the renter/charterer, the operator named above, or their employees, agents, servants or assigns. I FULLY AGREE IN CONSIDERATION FOR BEING ALLOWED TO PARTICIPATE IN THE CHARTER TO HOLD HARMLESS AND IDEMNIFY THE OWNER, THE OPERATOR NAMED ABOVE OR THEIR EMPLOYEES, AGENTS, SERVANTS OR ASSIGNS FOR ANY INJURY WHICH MAY BEFALL ME, MY MINOR CHILDREN OR THOSE CHILDREN FOR WHOM I AM LEGALLY RESPONSIBLE (INCLUDING DEATH).
